Is it true that after filing for bankruptcy I will not be able to obtain any credit for a long time?

Although it is true that a bankruptcy will stay on your credit report for 10 years, you should start rebuilding your credit as soon as your bankruptcy is completed. We encourage our clients to obtain small limit credit cards and pay them responsibly every month to start rebuilding your credit. After your bankruptcy is done, an attorney from our office will give you tips and advice on how to rebuild your credit sooner.

I have never been in court before, and I am worried about my court date related to my bankruptcy.

Everybody who has filed for bankruptcy has to go to court. You will not see a judge, but a trustee. The court proceedings are informal and short. The questions that  trustee will ask you will be the questions that you went over with an attorney from our office. An attorney from our office will be sitting next you to make sure everything goes smoothly.

I have filed for bankruptcy but the creditors are still harassing me. What should I do?

If the creditors are still calling you, please contact our offices and an attorney from our offices will call the creditor to let them know that they are in violation of federal law. In  most cases, the creditor wants to hear from an attorney and wants your bankruptcy case number.

I owe many back taxes and I am not sure that I can get rid off them through my bankruptcy. What should I do?

The best thing to do is contact a bankruptcy attorney and set up a consultation. Some back taxes are dischargable through a bankruptcy, some are not. Your attorney should be able to advise you on your tax issue.

I haven’t been charged with a crime or arrested but I might be in trouble. What should I do?

You should contact a criminal defense attorney as soon as possible.  An experienced criminal defense attorney can step in and try to influence the process in your favor so that the charges are not filed or a less serious charge is filed instead.

Should I talk to the police?

If you have been arrested, the police must read you your Miranda rights before any questions are asked.  Some of your rights include the right to remain silent and the right to an attorney.

When questioned by the police it is almost always better to assert your Miranda rights and politely ask for an attorney and advise the officers that you wish to remain silent.

Why do I need a lawyer?

Only a trained and skilled attorney can evaluate your case and advise you on whether you should go to trial or plea bargain your case.  If going to trial is not in your best interest your attorney will negotiate a favorable plea with the prosecutor.  If you have not been charged with a crime yet, hiring an attorney will give you an upper hand in building and strategizing your defense.  Presenting your side of the story prior to any charges being filed may influence the prosecutor not to file at all or to file less serious charges.

What should I do if I get arrested for a DUI?

The most important thing is not to attempt to handle your case on your own. You should hire an attorney within 10 days of your arrest so that the attorney can represent you at your DMV hearing.

Remember you have only 10 days before your DMV hearing or your license will be suspended pursuant to your local DMV agency rules.

What happens with my driver’s license after I am arrested for a DUI?

When you are arrested, the officer will take your license and give you a slip that will act as a temporary license for a short period of time. You can regain your license only if you win your case or when your suspension/revocation period passes.
